L&#8217;objet du message : &#8220;Le Portugal vient de doubler la taxe pour les acheteurs \u00e9trangers ?? Est-ce vrai ?&#8221; <\/p>\n\n<p class=\"wp-block-paragraph\">Les gros titres ont \u00e9t\u00e9 brutaux. La r\u00e9alit\u00e9, lorsque vous vous asseyez avec une calculatrice, est beaucoup moins dramatique. <\/p>\n\n<p class=\"wp-block-paragraph\">Voici ce qui a chang\u00e9 et ce que co\u00fbte r\u00e9ellement une villa d&#8217;un million d&#8217;euros \u00e0 Lagos.<\/p>\n\n<h2 class=\"wp-block-heading\">Ce qui a pris effet le 21 mai 2026<\/h2>\n\n<p class=\"wp-block-paragraph\">Le nouveau Decreto-Lei n.\u00ba 97\/2026 du Portugal a \u00e9t\u00e9 publi\u00e9 dans le Di\u00e1rio da Rep\u00fablica le mercredi 20 mai et est entr\u00e9 en vigueur le lendemain. Principal changement pour les acheteurs am\u00e9ricains : un imp\u00f4t forfaitaire de 7,5 % sur les transferts de propri\u00e9t\u00e9 (IMT) pour les biens r\u00e9sidentiels achet\u00e9s par toute personne qui n&#8217;est pas r\u00e9sidente fiscale portugaise au moment de l&#8217;achat. Pas d&#8217;exon\u00e9rations, pas de bar\u00e8me progressif, pas de d\u00e9ductions.<\/p>\n\n<p class=\"wp-block-paragraph\">Cette mesure remplace le syst\u00e8me pr\u00e9c\u00e9dent, dans lequel les non-r\u00e9sidents payaient le m\u00eame bar\u00e8me progressif d&#8217;IMT que les r\u00e9sidents. Cela repr\u00e9sentait un taux d&#8217;imposition effectif de 5 \u00e0 6 % aux prix pratiqu\u00e9s par la plupart des acheteurs am\u00e9ricains. <\/p>\n\n<h2 class=\"wp-block-heading\">La villa de Lagos d&#8217;un million d&#8217;euros : non-r\u00e9sident ou r\u00e9sident ?<\/h2>\n\n<p class=\"wp-block-paragraph\">Laissez-moi vous montrer le calcul r\u00e9el d&#8217;une villa d&#8217;un million d&#8217;euros \u00e0 Lagos. Je maintiendrai tous les autres co\u00fbts identiques afin que vous puissiez voir pr\u00e9cis\u00e9ment o\u00f9 la nouvelle loi s&#8217;applique. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>En tant que non-r\u00e9sident (le nouveau taux forfaitaire) :<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>IMT : 1 000 000 \u20ac \u00d7 7,5 % = 75 000 \u20ac.<\/li>\n<li>Droit de timbre (Imposto do Selo) : 8 000 euros<\/li>\n<li>Notaire, avocat, enregistrement : environ 10 000 euros<\/li>\n<li><strong>Co\u00fbt total de la transaction : environ 93 000 euros<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>En tant que r\u00e9sident fiscal portugais (ou non-r\u00e9sident dans le cadre de la proc\u00e9dure de remboursement, voir ci-dessous) :<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>IMT : 1.000.000 \u20ac au taux unique de 6% = 60.000 \u20ac.<\/li>\n<li>Droit de timbre : 8 000 euros<\/li>\n<li>Notaire, avocat, enregistrement : environ 10 000 euros<\/li>\n<li><strong>Co\u00fbt total de la transaction : environ 78 000 euros<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">La nouvelle loi co\u00fbte \u00e0 un non-r\u00e9sident am\u00e9ricain <strong>15 000 euros<\/strong> de plus pour une villa de Lagos d&#8217;une valeur de 1 million d&#8217;euros. C&#8217;est le chiffre r\u00e9el. Ce n&#8217;est pas un doublement. Pas catastrophique. Mais il est important et vaut la peine d&#8217;\u00eatre structur\u00e9 en cons\u00e9quence.    <\/p>\n\n<h2 class=\"wp-block-heading\">Les deux voies de remboursement<\/h2>\n\n<p class=\"wp-block-paragraph\">Le d\u00e9cret-loi est plus s\u00e9v\u00e8re qu&#8217;il n&#8217;y para\u00eet sur un point pr\u00e9cis : vous devez payer la totalit\u00e9 des 7,5 % au moment de l&#8217;inscription, sans exception ni remise anticip\u00e9e. Il est plus convivial qu&#8217;il n&#8217;y para\u00eet sur un autre point : vous pouvez r\u00e9cup\u00e9rer la diff\u00e9rence si vous faites l&#8217;une des deux choses suivantes dans les ann\u00e9es qui suivent l&#8217;achat. <\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Devenir r\u00e9sident fiscal portugais dans les 24 mois suivant l&#8217;achat.<\/strong>  C&#8217;est la voie que devraient suivre la plupart des acheteurs am\u00e9ricains qui pr\u00e9voient r\u00e9ellement de vivre ici. \u00c9tablissez votre r\u00e9sidence, remplissez votre premi\u00e8re d\u00e9claration \u00e0 l&#8217;IRS en tant que r\u00e9sident fiscal, et vous r\u00e9cup\u00e9rerez le delta de 15 000 euros. <\/li>\n<li><strong>Engagez-vous \u00e0 louer le bien \u00e0 long terme \u00e0 des loyers mod\u00e9r\u00e9s pendant au moins 36 mois au cours des 5 premi\u00e8res ann\u00e9es.<\/strong>  Cette voie existe, mais le plafond de loyer mod\u00e9r\u00e9 (actuellement 2 300 euros par mois en 2026) est bien inf\u00e9rieur \u00e0 ce qu&#8217;une villa de Lagos d&#8217;un million d&#8217;euros rapporterait sur le march\u00e9 libre. Elle est rarement utile pour les investisseurs purs. Il est plus utile pour les acheteurs qui pr\u00e9voient de d\u00e9m\u00e9nager \u00e0 terme, mais qui ont besoin de louer l&#8217;appartement pendant les premi\u00e8res ann\u00e9es.  <\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Dans les deux cas, le m\u00e9canisme est le m\u00eame. Vous payez 75 000 euros \u00e0 l&#8217;inscription. Vous r\u00e9cup\u00e9rez 15 000 euros une fois que vous avez rempli la condition. L&#8217;impact sur les liquidit\u00e9s est r\u00e9el (vous avez besoin du montant total le jour de la cl\u00f4ture), mais le co\u00fbt \u00e0 long terme se situe au niveau du taux r\u00e9sident.   <\/p>\n\n<h2 class=\"wp-block-heading\">L&#8217;angle du dollar<\/h2>\n\n<p class=\"wp-block-paragraph\">Le changement d&#8217;IMT est la partie la plus facile de cette histoire. La partie la plus difficile \u00e0 aborder est celle de la monnaie, et c&#8217;est l\u00e0 que les calculs surprennent les acheteurs am\u00e9ricains. <\/p>\n\n<p class=\"wp-block-paragraph\">L&#8217;EUR\/USD se situe \u00e0 1,1622 au moment o\u00f9 j&#8217;\u00e9cris ces lignes, le 21 mai 2026. Le dollar s&#8217;est raffermi par rapport \u00e0 l&#8217;euro en avril et en mai, par rapport \u00e0 la fourchette de 1,18+ que nous avons connue \u00e0 la fin de l&#8217;ann\u00e9e derni\u00e8re. <\/p>\n\n<p class=\"wp-block-paragraph\">Sur une villa d&#8217;un million d&#8217;euros, ce mouvement \u00e0 lui seul vaut \u00e0 peu pr\u00e8s la peine :<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Fin 2025 (EUR\/USD autour de 1,18) :<\/strong> 1M\u20ac = 1 180 000<\/li>\n<li><strong>Aujourd&#8217;hui (EUR\/USD 1,1622) :<\/strong> 1M\u20ac = 1 162 200<\/li>\n<li><strong>Vous \u00e9conomisez environ 17 800 dollars<\/strong> rien que sur la position du FX par rapport \u00e0 celle qu&#8217;il occupait il y a six mois.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">C&#8217;est presque exactement le co\u00fbt en dollars de la nouvelle hausse de l&#8217;IMT. 15 000 euros de taxe suppl\u00e9mentaire se convertissent en environ 17 400 dollars au taux d&#8217;aujourd&#8217;hui. Donc, si vous achetiez d\u00e9j\u00e0 Lagos \u00e0 la fin de l&#8217;ann\u00e9e derni\u00e8re, l&#8217;\u00e9volution du dollar depuis lors a essentiellement absorb\u00e9 la totalit\u00e9 de l&#8217;impact de la TMI. Vous n&#8217;avez rien \u00e0 d\u00e9bourser en dollars par rapport \u00e0 l&#8217;achat de la m\u00eame villa en novembre 2025.   <\/p>\n\n<p class=\"wp-block-paragraph\">Il ne s&#8217;agit pas d&#8217;un argument en faveur de la pr\u00e9cipitation. C&#8217;est un argument pour cesser de lire les titres de panique et faire ses propres calculs. <\/p>\n\n<h2 class=\"wp-block-heading\">Ce que je dirais \u00e0 un acheteur am\u00e9ricain se rendant \u00e0 Lagos cette semaine<\/h2>\n\n<p class=\"wp-block-paragraph\">Trois choses.<\/p>\n\n<p class=\"wp-block-paragraph\">Tout d&#8217;abord, si vous avez l&#8217;intention de vivre ici, \u00e0 temps plein ou \u00e0 temps partiel, avec un visa D7 ou D8, la proc\u00e9dure de remboursement rend tout ce changement inutile. Planifiez le calendrier de r\u00e9sidence avant de signer le CPCV (le contrat \u00e0 ordre). Le d\u00e9lai de 24 mois commence \u00e0 courir \u00e0 partir de l&#8217;escritura.  <\/p>\n\n<p class=\"wp-block-paragraph\">Deuxi\u00e8mement, si vous \u00eates un investisseur pur et dur qui n&#8217;a pas l&#8217;intention de d\u00e9m\u00e9nager, le co\u00fbt a r\u00e9ellement augment\u00e9 d&#8217;environ 1,5 % du prix d&#8217;achat. Ce n&#8217;est pas rien, mais cela ne change pas le cas d&#8217;investissement pour un bien immobilier Lagos bien situ\u00e9 o\u00f9 les rendements annuels plus la croissance du capital atteignent g\u00e9n\u00e9ralement des multiples de ce chiffre. <\/p>\n\n<p class=\"wp-block-paragraph\">Troisi\u00e8mement, surveillez le taux de change. Les chiffres ci-dessus sont bas\u00e9s sur le taux actuel. Une variation de 2 \u00e0 3 % dans un sens ou dans l&#8217;autre fera varier votre co\u00fbt total d&#8217;un montant sup\u00e9rieur \u00e0 celui de la modification de l&#8217;IMT elle-m\u00eame.  <\/p>\n\n<p class=\"wp-block-paragraph\">Si vous \u00eates en attente d&#8217;offres ou si vous \u00eates en train d&#8217;acheter activement, la structure de votre achat (et le moment o\u00f9 vous d\u00e9clenchez la r\u00e9sidence) est plus importante que le taux d&#8217;imposition global.
